Terms of sale
The formal side, in short.
These terms apply when a group pays for more storage in kauke, and when the organiser of an event buys invitation by SMS. If you use the free plan, there is nothing to buy, and then only the privacy notice applies.

The buyer is the group that orders, through whoever has the right to commit it. If the buyer is a team, a band, a choir or another association, the purchase counts as a business purchase. If the buyer is a private individual, the rules for consumer purchases apply as well, and that is set out below where it makes a difference.
If you pay by card, the purchase goes through Stripe, and Stripe is then formally the seller. Stripe handles the receipt, the VAT and any repayment, while kauke delivers the service, and these terms apply in the same way. Stripe's own terms for the purchase are shown before you pay.
What you buy
You buy the paid plan for one group for twelve months. It gives more storage and longer videos than the free plan. What is included is on the pricing page, and those numbers are the ones the service actually enforces.
Prices
The price is 1500 kr per group per year, VAT included. The price is the same however many members the group has. If we change the price, the new price applies from the next invoicing, and we say so well in advance.
If you pay by card, the price is 1500 kr, and VAT in the country you belong to is added, in Norway too. The amount is charged in Norwegian kroner, and the total is shown before you pay.
Invitation by SMS
The organiser of a standalone event can buy a send of the invitation by SMS. The price is 3 kr per send plus 1 kr per recipient. With Vipps, VAT is included. The amount is reserved before anything is sent, taken once the messages have been sent, and released again if none of them got through. By card a send costs at least 10 kr, and VAT in your country is added. The amount is charged at once and refunded in full if none of the messages got through. The purchase is complete when the messages have been sent.
Payment
You get an invoice from Steinholm Software with a twelve-day payment deadline, and pay for one year at a time. Late payment carries interest under the Norwegian Late Payment Interest Act. We never delete content because an invoice is unpaid. If it stays unpaid, the group goes back to the free plan.
Where kauke offers card payment, you pay at Stripe, and the amount is charged at once. You get a receipt from Stripe and no invoice from Steinholm Software. We do not store the card, and nothing is charged later unless you pay again yourselves.
Delivery
This is a digital service, and it is delivered as soon as the payment is registered: the group gets the new room immediately, and you need do nothing. If it takes more than one working day, say so at kontakt@kauke.no.
Commitment and cancellation
There is no commitment beyond the year you have paid for, and nothing renews by itself. We send a new invoice when the year is coming to an end, and if you choose not to pay it, that is the cancellation. The group then goes back to the free plan.
If you paid by card, we send no invoice and charge nothing to the card when the year is over. If you want another year, you pay again. If you do not, the group goes back to the free plan.
The content stays. If you have stored more than the free plan holds, you cannot upload anything new until you have deleted something, but we delete nothing for you, and everything already there is still visible and possible to download.
Right of withdrawal
If the buyer is a consumer, the Norwegian Right of Withdrawal Act applies, with a fourteen-day withdrawal period from the day the agreement was made. For a digital service that is delivered straight away, the right of withdrawal falls away when delivery is complete and the buyer has consented to it.
If the buyer is a team or an association, the Right of Withdrawal Act does not apply. We give the same deadline anyway: say so within fourteen days, and you get your money back, without having to give a reason. Send an e-mail to kontakt@kauke.no. We pay back within fourteen days of hearing from you.
If you live in another country, the right of withdrawal where you live applies, with at least fourteen days in the EU and EEA. For card payments the repayment goes through Stripe, which is the seller. Write to us either way, and we will sort it out.
Returns
A digital service cannot be returned the way goods can. If you want out of the agreement, it is the right of withdrawal above or the cancellation that applies. Repayment goes to the account the invoice was paid from, or to the card that was charged.
Handling complaints
If the service does not work as it should, say so at kontakt@kauke.no within reasonable time after you discovered the fault. Describe what is wrong, and we will answer as fast as we can, and within ten working days at the latest. If the fault is at our end, we put it right. If we cannot put it right, you can demand a reduction in the price or cancel the purchase and get back the part of the year you did not get to use. The complaint deadlines follow the Norwegian Sale of Goods Act, and the Consumer Purchases Act where that applies. If you live in another country, you keep the rights that cannot be waived there.
Resolving disputes
Get in touch with us first, because most things are settled there. If we cannot agree, a consumer can complain to the Norwegian Consumer Council, which mediates in the case. If you live in another EU/EEA country, you can also complain to the consumer authorities where you live, and ECC Norway helps with cross-border complaints. Disputes can otherwise be brought before the ordinary courts, with Norwegian law and the seller's venue as the starting point. For a consumer, the rules of their home country that cannot be waived still apply.
Privacy
What we store about you, for how long, and who we share it with, is in the privacy notice. The purchase changes nothing about who sees the content in the group.
